Before January 1, 2031, an alternate sample plan applies to terminal inspections. It applies separately to power units and trailers. The law sets, for example, 14 units for terminals with 51–90 units and 20 units for 91–180 units, and may require 20 units even when a terminal has 1 or more units, as stated in the section.
The law states the terminal inspection program covers the vehicle types listed in subdivisions (a), (b), (e), (f), (g), and (k) of Section 34500. This listing applies until January 1, 2031. Carriers in those classes must follow inspection and related record rules.
Starting January 1, 2031, motor carriers must tell the state every in‑state terminal where their vehicles can be inspected and where records are kept. You must make vehicles and driver and maintenance records available on request; denying access can lead to an unsatisfactory rating. The department picks vehicles to inspect by terminal size: 1–2 units (all), 3–8 (3), 9–15 (4), 16–25 (6), 26–50 (9), 51–90 (14), 91+ (20). Lessors must make leased vehicles available during a lessee’s terminal inspection. If a terminal gets an unsatisfactory rating, the department reinspects within 120 days. If your permit or PUC authority is suspended because of that rating, the department waits to reinspect for reinstatement until DMV or the PUC asks. You can ask for a review within five business days; the department must decide within 10 business days. The department builds a performance‑based selection system and real‑time database and publishes inspection completion data.
The law defines an agricultural vehicle. It must be 26,000 pounds GCWR or GVWR or less, be driven by a farmer, farm employee, or agriculture instructor, be used only for farming when in commerce, not be for hire or for pay, have a towing vehicle of 16,000 pounds GVWR or less, and run only within the state. Beginning January 1, 2031, agricultural vehicles that meet this definition are excluded from the state’s terminal inspection program.
Some vehicles are not covered by the terminal inspection program. These include vehicles with special identification plates (Section 5011), historical vehicles (Section 5004), implements of husbandry and farm vehicles, and vehicles owned or operated by a federal agency. Owners of these vehicles do not have BIT inspection or record‑access duties.
Section 34501.12 becomes operative on January 1, 2031. The version in effect before that date remains only until January 1, 2031, when it is repealed unless the legislature extends or deletes the sunset.
