The law adds geothermal powerplants, including multi-plant sites, to projects the Energy Commission can certify. With this Environmental Leadership certification, the Commission’s approval stands in place of most other state or local permits. It also can override conflicting local rules unless the law preserves them. This can speed CEQA review and cut duplicate steps, but projects must meet the Commission’s requirements.
For certain clean-energy manufacturing projects, applicants must certify at least $250 million in capital investment over five years to qualify as a Facility. These projects include making or assembling energy storage, wind, solar, or specialized parts for renewable or storage technologies. A lower $100 million threshold applies only if both this law and SB 254 are enacted and effective by January 1, 2026, both amend the same section, and this law is enacted after SB 254. If the $100 million rule takes effect, the $250 million rule does not.
