Safeguards and limits on trust representation

A person with a conflict of interest cannot act as a representative. The person who created an irrevocable trust cannot act for a beneficiary to end or change that trust. Consent to be represented must be in writing. That consent binds the person unless they object before it takes effect.

Fiduciary safe harbor when relying on representation

A trustee or other fiduciary who relies on a valid representation is not liable for losses unless they acted intentionally, with gross negligence, in bad faith, or with reckless indifference to beneficiaries.

Notice to trust representatives counts

In trust and estate matters, giving notice to an authorized representative counts the same as notice to the person. “Notice” includes related papers and documents. A court decision under this law is final for the person who was represented. Existing special‑notice rights and guardian ad litem options still apply.

Who can act for trust beneficiaries

The law sets who may act for others in trust and estate matters. Parents may act for minor children when no guardian or guardian ad litem is appointed. Conservators, guardians of the estate, authorized agents, trustees, and personal representatives may act when they have authority. If no one else represents them, a person with the same interest may act for minors, incapacitated, unborn, or unknown persons. People who hold the same kind of class or future share, and holders of powers of appointment, can sometimes act for others with those shares.
