If the Commission on State Mandates finds this law creates local costs, the state reimburses local agencies and school districts. Repayment follows Government Code procedures. The law does not set specific dollar amounts.
Beginning Jan 1, 2027, agencies must follow set steps for the first formal interview with a victim’s immediate family after death or serious injury caused by a peace officer. The interviewer must give their full name and agency, show ID in person, and tell you your relative’s status and that this is a formal investigation that may or may not assess your relative’s conduct. You may bring a trusted support person, and you can choose whether to go to a station and bring that person. Officers and prosecutors cannot use threats or lies, including fake evidence or misleading statements, to get or conduct the interview. These rules skip only if delay risks losing evidence or an imminent safety threat, or if you already got similar advisements or Miranda; “immediate family” includes a spouse, parent, grandparent, sibling, child, or grandchild, and a support person cannot be a witness or suspect.
