The law creates one master reclamation plan for all MWD surface mining in Los Angeles, Orange, Riverside, San Bernardino, San Diego, and Ventura counties. The State Mining and Geology Board is the lead agency for mining oversight. MWD is the lead agency for environmental review of the plan. State surface mining laws and reporting rules apply to these operations. MWD does not need city or county approval of a reclamation plan or a local use permit to operate under the approved master plan. These authorities last until January 1, 2041.
MWD cannot sell, or let others use, materials mined from its lands, leases, easements, or rights-of-way. This ban remains in place until January 1, 2041.
MWD must file an annual mining report and include a separate subreport for each site. MWD must pay the annual reporting fee. As lead agency, the board may charge reasonable inspection costs and an administrative fee up to its reasonable costs. These charges apply until January 1, 2041.
The master plan must include a map showing each mining site on land MWD owns, leases, or controls. It must list maintenance steps that start when a site is idle or not producing. The plan is exempt from one idle-plan filing rule, but financial assurances must stay in place while idle. The board may inspect an idle site once every two calendar years. These rules apply until January 1, 2041.
