The Authority now finances a wider range of health facility projects and costs. Eligible participants include cities, counties, health care districts, nonprofit corporations, certain LLCs, and affiliated nonprofits. Projects can include building, expanding, remodeling, equipping, buying, and reimbursing prior costs, and can be done jointly. Covered costs include land, buildings, equipment, insurance during construction, financing charges, and interest before, during, and up to one year after completion, plus planning, studies, professional fees, and reserves. Covered facilities include hospitals, clinics, nursing homes, mental health centers, some elderly residential care, and related information systems and support buildings; financing cannot support sectarian instruction or worship.
The Authority sets one set of financial tests for projects and for working-capital loans. It checks creditworthiness, pledged revenues, expected earnings, debt-service coverage, and basic security. If the Authority finds an institution is in financial distress, it is not eligible for financing. These rules guide which applicants can receive CHFFA support.
The law defines revenue bonds for this program. The Authority can issue bonds, notes, leases, installment-sale obligations, and certificates of participation. This gives more ways to finance or refinance health projects.
The law repeals Government Code Section 15451.5. Any separate authority or process in that section no longer applies. Other updated CHFFA rules in this act remain in effect.
