Named weirs and small barriers not dams

The law changes what counts as a dam. A barrier 6 feet tall or less is not a dam. A barrier that holds 15 acre-feet or less is also not a dam. Nine named weirs are exempt when they meet levee rules. They are Peoples, Reynolds, Last Chance, Lemoore Diversion, Island, Crescent, Stinson, Empire No. 1, and Empire No. 2. For those weirs, water cannot rise above the levee top. Storage must leave at least 3 feet of freeboard on the levee. A "weir" is an agricultural delivery structure with removable flashboards or gates. It regulates stream flow and is part of the federal flood control system in 33 CFR Part 208.
