The law ensures incarcerated parents get notice of key hearings about their child, including termination, dependency, and parentage. Courts use existing service rules to deliver that notice. If the parent or their lawyer asks, the court orders the parent produced for the hearing. Courts may not decide certain cases without the parent present or an attorney, unless the parent signs a waiver or the facility files an affidavit. Covered people include those in state prisons, the California Rehabilitation Center, county jails, secure youth treatment facilities, and state hospitals or other treatment after insanity or incompetence findings. Removal orders go to the facility at least 15 days before they are carried out; the sheriff brings the parent, keeps custody during court, and returns them, and the parent stays in the facility’s legal custody. If the parent is not produced or waives, the court must allow video participation when available, or phone if not; remote tech does not replace in‑person family visits. Courts cannot order transport for people sentenced to death in parental‑rights cases.
Minors and nonminor dependents have the right to be at their juvenile court hearings. They can choose their own lawyer. If they are present, the judge must tell them they can speak and must let them speak. If a child age 10 or older or a nonminor is not there, the court checks notice. If notice or a chance to attend was missing, the court delays briefly to let them attend, unless delay is not in the child’s best interest.
The county that issues an order to bring a prisoner to court pays the costs to carry it out. If the Commission on State Mandates finds state‑mandated costs, the state reimburses local agencies and school districts under Government Code procedures.
