Stricter rules for plan certifiers

To certify plans, you must be a licensed architect or engineer with at least 5 years of commercial design or plan‑review experience and carry at least $2,000,000 in professional liability insurance per claim. You are liable for damages from negligent plan review. A false statement in a certification can lead to discipline by the Architects Board or the Engineers Board, including public reproval, suspension, or revocation. Cities and counties may add registration, training, reasonable fees, and penalties for willful or repeated noncompliance.

Faster restaurant remodel permits statewide

You can ask to use a qualified certifier, at your expense, to attest your restaurant remodel meets building, health, and safety codes. The local building department must approve or deny a complete application in 20 business days. If it does not act and you submitted all required fees and documents, the plan is deemed approved for permitting. If denied, fixes limited to listed issues must be decided in 10 business days. These rules apply in every city, including charter cities.

Inspections, audits, fees, and liability remain

Certification does not replace required fire, structural, or health inspections, and local health departments keep their authority. Local building departments can charge normal permit fees. They must randomly audit at least 20% of certified plans each week, start audits within 5 business days of permit issuance, and issue any correction notice within 10 business days. Permit applicants must indemnify the local agency for injuries or property damage from the construction. Public entities and employees are not liable for injuries tied to issuing or denying permits under this chapter.
