New narrow exceptions for fully protected wildlife

The law keeps the ban on taking fully protected birds and mammals. The Department can allow take for necessary scientific research and, for birds, live capture and moving to protect livestock. It must publish a notice and give at least 30 days for people to comment before approving. It also recognizes the new SR 37 project section as a limited exception. Routine project mitigation does not count as scientific research.

SR 37 project can get species permits

The Department of Fish and Wildlife can allow incidental harm to four protected species for the SR 37 Sears Point to Mare Island project. The permit only covers the salt‑marsh harvest mouse, California Ridgway’s rail, California black rail, and white‑tailed kite. The project must avoid harm as much as possible, fully offset impacts, and run department‑approved monitoring and adaptive management. The applicant must meet the usual permit findings and pay the standard application fee. The permit can also cover impacts during required mitigation work, and conditions can change based on monitoring.
