Real estate brokers and agents must say when a listing photo is digitally altered. They must place a clear notice on or next to the image. The notice must include a link, URL, or QR code. That link must lead to a public site showing the original, unaltered photo, clearly labeled. If the listing is on a site they control, they must include the unaltered images or a public link to them. The notice must say unaltered images are available at the link. Edits that add, remove, or change elements like walls, fixtures, paint, landscaping, views, or floor plans count as altered. Simple fixes like lighting, color, cropping, straightening, exposure, or sharpening do not need a notice. Willful violations are a crime under California Real Estate Law.
