Cities and counties must send an annual planning report by April 1 to their council or board, the Office of Land Use and Climate Innovation, and the state housing department (HCD). The report covers housing element progress, applications, approvals and denials by income level, and where projects are located. It must use the latest Opportunity Map to classify “opportunity areas.” It must also list rezoned sites, density bonus activity, and units in student housing for lower‑income students that got a density bonus. HCD posts each report online so the public can see it.
HCD sets the standards, forms, and definitions for the housing element part of the annual report, and local governments must use them. HCD can ask for corrections within 90 days of getting a report, and cities must fix issues within 30 days or HCD can reject the housing element portion with written reasons. If a city misses the report deadline by 60 days, a court must order compliance within 60 days and may add sanctions for continued noncompliance. This court rule applies to cases filed on or after the October 1 after HCD adopts the forms and at least six months after that adoption.
Reports must use a unique site ID that includes the assessor’s parcel number for each entitlement, permit, or certificate of occupancy. Beginning with the report due April 1, 2027, cities must show total replacement housing by income level and list how many replacement units by income level were entitled, permitted, or issued certificates of occupancy. Also starting with the 2027 report, cities must include a demolition report with site IDs, approval dates, rental vs. ownership unit counts, income levels of protected units, planned uses, and details on relocation help provided.
Cities may include preserved affordable homes in their annual report if the units are at least 15 years old, have average affordability at or below 45% of area median income, and got at least $60,000 per unit from the city or county for substantial rehab, including forgiven principal or interest. These reported rehabbed units do not count toward the affordability test used for certain streamlined approvals under state law.
