Per-acre fines for pest nuisances

The county agricultural commissioner can fine you up to $500 per acre for a pest nuisance that harms or could harm a nearby property. This is used instead of placing a lien. The commissioner weighs how severe the problem is and your ability to pay. If you do not fix it in good faith within 45 days after the penalty is issued, the fine can rise to as much as $1,000 per acre. Your total fine equals the per‑acre amount times the acres affected.

Fix pests fast, avoid fines

If you take a good faith action to fix the problem within 30 days after you get the notice, you do not owe the civil penalty. A “good faith action” means a diligent, honest effort to abate the nuisance, judged by a reasonable person.

Biocontrol and soil practices protected

A “pest” does not include beneficial organisms used for biological control or certain conservation and on‑farm practices listed by NRCS or the Healthy Soils Program. Using those practices alone cannot be the only evidence of a violation. County officials can still abate pests in neglected or abandoned plants or crops.

Notice and appeals for pest fines

You must get at least 30 days’ written notice before a civil penalty. The notice must tell you how to review the evidence and present your own. It must list the UC Integrated Pest Management website and refer you to your nearest UC Cooperative Extension office. If you cannot be found in the county, notice can be posted or mailed to your last known address. Standard appeal rules in Section 5311(d) apply.

Enforcement funding and 2035 end date

Any penalty money recovered goes to the county’s general fund and is allocated to the agricultural commissioner to cover enforcement costs. All rules in this article end on January 1, 2035, when the article is repealed.
