Beginning January 1, 2027, you can move to vacate a default judgment that is void for improper service at any time. If you were not lawfully served, you can ask the court to set aside the default and let you defend by filing evidence; the court must take evidence and reasonably allow a hearing with testimony. A proof filed before this law took effect is not unlawful just because it lacks a photo. If service was lawful but you had no actual notice in time, you can move within the earlier of two years after entry or 180 days after written notice of the default. Your motion must include an affidavit showing you did not avoid service or act with inexcusable neglect, and a proposed pleading.
Beginning January 1, 2027, you must try personal delivery at least three times on three different days and times before using substituted service. When you leave papers at an office, home, or usual mailing address, you must mail a copy by First‑Class, Priority with tracking, or Certified Mail with return receipt. Service is legally complete on the 10th day after mailing. If the only known address is a private mailbox at a commercial mail receiving agency, you can serve by leaving the papers there on the first attempt. In consumer‑debt cases, at least one attempt must be at the person’s home if it is known or can be found with reasonable effort.
Beginning January 1, 2027, posting a summons in an eviction case is allowed only after at least three in‑person attempts on different days and times. If the home is known, one attempt must be at the dwelling, unless it is commercial property or a covered program participant. Eviction complaints must be verified and must say how the termination notice was served, including the date, time, and place. In residential cases, landlords must attach the termination notice and any written lease unless a listed exception applies. If required papers are missing, the court gives five days to fix the complaint.
Beginning January 1, 2027, county clerks keep a public register of process servers. Registrants get a registration number and an ID card. If a Live Scan is required, the clerk issues a free 120‑day temporary card; a permanent card is mailed if state and federal clearances arrive within 120 days. ID cards must be at least 3 1/4 by 2 inches and show the name, address, number, expiration date, and county; a person’s card includes a photo, while a company card does not. Proofs of service must list the server’s registration number and include photos of the service location with date, time, and GPS data when feasible, with safety or no‑signal explanations when needed.
