Pay or new rest for refinery staff

If your employer makes you stop a rest break for an emergency, they must let you take another break soon after. If you cannot take that replacement break, your employer must pay you one hour at your regular rate. Your pay statement must show any hours or pay owed for rest breaks you were not allowed to take.

On-call rest rules for refinery workers

The law lets safety-sensitive employees at petroleum facilities or other refineries stay on duty, carry a device, or remain on site during rest breaks to handle emergencies. This exception is now permanent. It applies only to workers under Wage Order No. 1 and only when a valid union contract covers rest breaks, has binding arbitration, pays premium overtime, and pays at least 30% above the state minimum wage. The law defines which facilities, jobs, and emergencies count, including refineries using alternative feedstock. It does not affect cases filed before this section took effect.
