The law treats daycares inside or on the grounds of apartment buildings with 5 or more units as a residential use by right. Cities cannot require conditional use permits, planned unit permits, or other discretionary reviews that trigger state environmental review as a project. Design review can still happen, but it does not count as a project under that law. Local limits on height, setbacks, lot size, health, safety, building, and environmental rules must match the rules for the colocated apartments. Nuisance laws cannot single out the daycare, and these rules apply statewide, including charter cities.
If a daycare is inside or on the grounds of an apartment building with 5 or more units, local governments cannot charge a business license or similar permit fee to operate it. This ban lowers local licensing costs for colocated daycare operators.
All daycare centers, including those in or on the grounds of apartments, must follow the California Building Standards Code, the California Fire Code, and other state life and fire safety laws. They also must meet state daycare licensing rules. The law does not relax any state safety or licensing requirements.
