Marin floating home rent and resale rules

Beginning July 1, 2025 in Marin County, annual rent hikes must be at least 3% and no more than 7.5%. The CPI‑U change sets the cap, and only half of any increase above 5% counts toward it. After an in‑place sale, the first rent is capped at the smaller of a 25% raise or 0.15% of the sale price; if that is under 3%, the CPI‑U change (between 3% and 5%) applies. The buyer must certify the sale price in writing under penalty of perjury. From July 1, 2025 to July 1, 2026, these transfer limits apply to all in‑place transfers. Leases offered after an in‑place transfer must be at least 10 years, and if the home resells within five years, the new first rent is capped at the smaller of a 15% raise or 0.15% of the sale price. Management must give written notice of increases. Deed‑restricted affordable berths and berths under stricter local caps are exempt. Local rules that allow bigger increases are overridden, and you cannot waive these rights. These Marin rules end January 1, 2038.

Rent limits for Bay Area floating homes

The law caps berth rent hikes at 3% plus the local CPI‑U change, or 5%, whichever is lower. It applies in Alameda and Contra Costa Counties, and in Marin until June 30, 2025. Management can raise rent at most twice in any 12 months and must give written notice. If you buy and keep the home in place, the first rent matches the prior rent. For a brand‑new tenancy, the owner may set the first rent, unless a stricter local rule applies. If your rent rose too much in 2022, it resets on January 1, 2023 to the legal amount, with no payback owed. The law uses the San Francisco‑Oakland‑Hayward CPI‑U (April year‑over‑year, rounded to the nearest tenth). Local rules that allow bigger increases are overridden, but deed‑restricted affordable berths and berths under stricter local caps are exempt. You cannot waive these rights. These rules end January 1, 2030.

Limits on marina fees and charges

Statewide, homeowners can be charged only rent, utilities, and reasonable fees for services actually provided. You cannot be charged a fee to get a 12‑month rental agreement, unless you agree to a longer term and a fee. In Marin County, utility and incidental fees must match real costs, and the marina must show the service was provided. Marin marinas cannot charge fees to enforce marina rules. These fee rules end January 1, 2038.
