Creditors can restore released property liens

Beginning July 1, 2026, creditors may ask the court to reinstate judgment liens on real or personal property with their original priority. If no timely objection is filed, the clerk issues a certificate that can be recorded to restore priority. Debtors get notice and a short time to object. Knowingly false information can be penalized up to $1,500. Attorney fees are not recoverable under this process.

Stronger wage garnishment and levy protections

For personal-debt cases, the creditor must verify your address within the last 12 months and file a declaration within 10 business days; the sheriff cannot serve papers without it. Wage withholding starts on day 30 after your employer is served, or on day 45 if you file an exemption claim and your employer gets actual notice by day 29. If the court cannot hear your claim within 30 days, it must pause the levy or garnishment until the hearing. When wages are exempt, the court orders money back: up to 12 months if no claim was filed in a personal‑debt case, or up to 6 months if you filed a claim; the court may allow more for good cause. The levying officer must return money within 20 business days of notice, and the creditor must return money within 10 business days; you may file a late claim after 20 days in personal‑debt cases, but the officer may still release funds after day 20.

Employers must file sworn garnishment return

Employers must mail a sworn return to the levying officer within 15 days after service of an earnings withholding order, by first‑class mail, postage prepaid. The return must state the service date, whether the person works there, last pay‑period earnings and length, any prior withholding or support orders and their priority, a notice contact, and when and how the employee got the order and notice.
