Campaigns can fund security for candidates

Campaign funds can pay for security when threats come from a person’s role as a candidate or elected officer, or from staff duties. Security costs include installing and monitoring a home or office alarm system, reasonable personal security, and other tangible security items. Payments to certain listed relatives and for firearms are not allowed. If another law (AB 808) also amends these same rules by January 1, 2026, the version that becomes operative first applies until the other takes effect.

Report spending and verify threats

Security spending and any repayments must be listed on campaign statements. A Commission form, signed under penalty of perjury, must explain and verify the threat that led to the expense. Campaigns must keep bills, receipts, and evidence of the threat and provide them if asked.

No cap now, $10,000 in 2029

There is no dollar cap on campaign-funded security expenses until January 1, 2029. Starting January 1, 2029, these security costs are capped at $10,000 per calendar year for each candidate or elected officer, no matter how many offices they seek or hold.

Return or repay security items

If a campaign buys a home or office security system or other security item, the item must be returned or repaid. Return or repayment is due within one year after leaving the office tied to the purchase, when the person is no longer a candidate for that office, or when the property is sold, whichever comes first. If law enforcement verifies a continuing threat, the deadline is within one year after the threat ends or on sale. Repayment equals the item’s fair market value when paid or due. The candidate or elected officer is responsible for payments. Immediate family and staff are not personally liable.
