Public reports and forums on hate

The commission provides resources and help to the Department of Justice, the Attorney General, emergency services, law enforcement, and the public. It collects data, does fact-finding, and sends a public report to the Governor and Legislature by July 1 each year. The first report was due July 1, 2023. Reports due on or after July 1, 2030 must include full statewide hate crime data, national trends, and detailed recommendations for police, policymakers, and communities. The commission holds at least four public forums each year, in person or online, with expert speakers. Data the commission uses is for research or statistics only and may not include personal information that can identify someone.

Who serves on the Hate Commission

The law creates the Commission on the State of Hate with nine voting members: five appointed by the Governor, two by the Assembly Speaker, and two by the Senate Rules Committee. Members serve four-year terms, with initial terms staggered so some serve three years and others four years. Legislators, the Attorney General (or a designee), and the emergency services director (or a designee) take part as nonvoting members. Commissioners elect a chair, can form advisory committees led by a commissioner, and may include outside advisers. Members may send a representative if they cannot attend. The commission may seek and accept federal grants and other funds outside the state General Fund.

Commission ends January 1, 2031

The commission and its legal authority end on January 1, 2031, unless the law is renewed.

Pay and expenses for commissioners

Appointed voting members get $100 for each public commission meeting and each commission community forum they attend. They can also be reimbursed for reasonable expenses. Legislative members, ex officio members, and nonmember advisers do not receive this pay or reimbursement.
