3 provisions identified: 2 benefits, 0 costs, 1 mixed.

Chaperones for sensitive ultrasounds

Beginning Jan 1, 2027, providers must tell you a medical chaperone is available for sensitive ultrasounds. Sensitive means an ultrasound of the genitalia, breast, rectum, or pubic/groin area. You can ask for a chaperone, and they stay for the whole exam if any part is sensitive. The provider must record the chaperone’s presence in your medical record. In emergencies, providers inform you when it is feasible. If no chaperone is ready, the provider must work with you on an acceptable option, like a short wait without undue delay. These rules apply to clinics and general acute care hospitals and do not apply to facilities run by the Department of Corrections and Rehabilitation.

Staff training for medical chaperones

Beginning Jan 1, 2027, providers must train sonographers and staff who may serve as chaperones. Training covers what to watch for, how to step in, proper draping, staying neutral, and how to report inappropriate behavior. This improves patient safety during sensitive ultrasounds. Some facilities run by the Department of Corrections and Rehabilitation are not covered.

Providers can require chaperones for exams

Beginning Jan 1, 2027, if you do not ask for a chaperone and the provider decides one is needed, they may refuse to do the sensitive ultrasound without a chaperone. This can delay the exam until a chaperone is available. The rule applies to clinics and general acute care hospitals, and it does not apply to facilities run by the Department of Corrections and Rehabilitation.
