Fines and jail for banned offers

Anyone who makes a banned unsolicited offer in those ZIP codes can be fined up to $25,000 per violation. Violators can also be convicted of a misdemeanor, with a fine up to $1,000 or up to six months in jail. The Attorney General, county counsel, city attorney, or district attorney can sue to enforce these rules. Penalties are on top of other remedies. These penalties end January 1, 2027.

Ban on unsolicited home-buying pitches

The law bans unsolicited offers to buy homes in ZIP Codes 90049, 90263, 90265, 90272, 90290, 90402, 91001, 91024, 91103, 91104, 91106, 91107, 91301, 91302, and 91320. An offer is allowed only if the owner already showed they want to sell (MLS listing, a for-sale sign, or a printed ad), or if the offer was made before this section was enacted. Companies and other organizations count as “persons” under these rules. The act is urgent to protect people hit by the January 7, 2025 wildfires. These rules start 30 days after the act took effect and end January 1, 2027.

License discipline for agents making banned offers

A real estate licensee who makes a banned unsolicited written offer in those ZIP codes while doing licensed work violates license law. The agent can face discipline, including loss of license. Which license rule applies depends on another bill (SB 641). If SB 641 takes effect by January 1, 2026 and changes Section 10176, that section governs; otherwise the base rule applies. These rules end January 1, 2027.

Sale form and 4 month cancel right

Before a title transfer in those ZIP codes, the buyer and seller must sign a form saying the deal did not come from a banned unsolicited offer. The buyer must record the form with the deed. If the form is missing, the deed still gives public notice and later good‑faith buyers keep their rights. The signed form creates a presumption the seller started the sale, unless clear and convincing proof shows otherwise. If a contract came from a banned offer, the seller can cancel it for up to four months after signing. These rules end January 1, 2027.
