The law requires every civil summons to list the court name and the parties. It must tell defendants to file a written reply within 30 days after service. It must warn that not responding can lead to default and money, property, or wage garnishment. It must include a bold note that you can seek a lawyer and should act quickly. A bold warning in English and Spanish must appear at the top. Counties may require the same top warning in more languages by local ordinance. A Judicial Council–approved summons form is treated as compliant.
For residential evictions, the Judicial Council must publish one mandatory summons by January 1, 2027. The form includes the 30-day reply rule, the default and garnishment warning, and the bold attorney note. The top warning appears in English, Spanish, Chinese, Tagalog, Vietnamese, and Korean. Courts use this form for all residential eviction cases once it is posted online.
