The law authorizes nurse anesthetists to provide anesthesia services. When a physician, dentist, or podiatrist orders anesthesia for a patient, the nurse anesthetist may choose the anesthesia type and change it during care. Anesthesia services include pre-, intra-, and post-operative care, pain management, and emergency and resuscitation support. Giving medicines, including controlled drugs, under such an order is not treated as a prescription under 21 CFR 1300.01.
A nurse anesthetist is a registered nurse licensed by the Board of Registered Nursing who meets Board certification rules. The Board looks at national certification standards and can set stricter rules to protect patients, following state procedures. Nurse anesthesia education programs must be approved by the Board. The Board considers national accreditation standards and can raise them if needed for safety.
The law states this article does not expand or limit the current scope of practice for nurse anesthetists. It is a statement of existing law meant to guide hospitals, boards, and courts.
