When an employer’s fringe payments are higher on public jobs than on the same employer’s private work, the law requires annualized credit calculations. Annualization is not required if the employer is bound to pay the higher rate on future private jobs, if a project labor agreement requires it, or for payments to the California Apprenticeship Council. Employers get full hourly credit for defined‑contribution pensions on public works if the plan allows immediate participation and vesting within the first 500 hours. Beginning January 1, 2026, any director‑issued exemptions from annualization granted before that date are revoked.
The law spells out what counts as per diem wages on public works. It includes employer-paid health, pension, vacation, travel, subsistence, some training costs, and certain worker‑protection and industry fees only when paid under a binding union contract. Employers get credit for irrevocable contributions to third‑party plans, for actual costs under a written, enforceable plan, and for payments to the California Apprenticeship Council. No credit applies to benefits required by other laws, or to certain fees unless tied to an obligated union agreement. Credits do not lower required straight‑time or overtime hourly pay. Hourly cash pay can be lower only if a union contract allows higher fringe payments, the total pay meets or beats both the prevailing per diem and holiday/overtime rates, and the contributions are irrevocable except to correct an error.
Worker representatives must file signed union contracts, and later changes that affect per diem wages or holidays, with the state labor department. A final draft may be filed temporarily with a sworn statement of the start date. Agreements filed at least 30 days before a bid call can be used to set prevailing wages. Not filing alone does not undo a correct wage decision.
Employers may claim a credit for a pay period even if the benefit payment is made later, as long as payments are made at least quarterly. Employers must prove credits are calculated correctly. On request, they must give the Labor Commissioner records of hours and benefit payments on private construction. The Commissioner may deny the credit if the employer does not provide the records.
