At the last review before 18, and at every later review, the court must make a plan that helps the youth meet the rules to stay in foster care as a nonminor. The court also tells the youth they can end dependency, and that they can ask to reinstate it later. Reports within six months before 18, and after, must show efforts to help the youth meet participation conditions, progress on required documents, and who will help with college and financial aid forms. For youth in short‑term residential treatment programs (approved on or after October 1, 2021) or community treatment facilities (approved on or after July 1, 2022), reports must show the placement is still the least restrictive, list treatment needs and expected duration, and show efforts to move the youth to family or a less‑restrictive home; Medi‑Cal services must meet medical‑necessity rules. Foster family agencies must report on services and compliance with the youth’s living plan, and confirm the youth got required papers; the court must hold a Section 391 hearing before ending dependency. The Judicial Council creates needed court rules and forms by January 1, 2023.
The law sets clear county residency rules for children and nonminor dependents. A child’s county follows the parent, guardian, or court‑placed caregiver with physical custody; a found infant’s county is where the child is found. If no other rule applies, the county where the child has lived for one continuous year becomes the child’s county. For nonminor youth in a planned permanent living arrangement, or after jurisdiction is resumed, the county can be where they have lived for a year and say they plan to stay. After parental rights are ended, the court’s county is the child’s county; these rules decide which county must provide foster care, Medi‑Cal, and other county services.
Nonminor dependents can ask to move their court case to another county. The court must issue the transfer order within 30 court days if it is in the youth’s best interest. The new county takes jurisdiction 10 calendar days after the order. A transfer can also follow a granted Section 388 petition in another county when the listed conditions are met.
