Local agencies can seek state reimbursement

Local agencies and school districts can be reimbursed for costs of this law if the Commission on State Mandates finds the costs are state‑mandated. Reimbursement follows Government Code Part 7 procedures. There is no automatic payment without a Commission determination.

State data adds Middle Eastern and North African categories

Beginning January 1, 2028, state and local agencies that collect ancestry or ethnic‑origin data must add separate categories for Middle Eastern groups, North African groups, and transnational groups. This applies when a form lets people select one or more ethnic or racial identities or languages. The California State University and the University of California are excluded. Beginning January 1, 2029, agencies include these counts in every ancestry or ethnic‑origin report they publish, and starting January 1, 2028, they publish aggregated data on their websites, following state and federal privacy laws.

Stronger privacy for Middle Eastern and North African data

Beginning January 1, 2028, agencies may not disclose personal identifying information collected under this law. They must publish only aggregated data and can aggregate by state, county, city, census tract, or ZIP Code to prevent identification. They must withhold data that would be statistically unreliable. Personal identifying information has the meaning in Penal Code section 530.55(b).
