The law bans foreign governments, foreign principals, and foreign nationals from giving or spending to sway state or local ballot measures or candidate elections. It also stops people and committees from asking for or taking such money. The ban covers direct payments and spending through others. The law defines who counts as a “foreign principal” and “foreign national.” Breaking the ban is a misdemeanor and carries a fine equal to the illegal amount.
The law lets lawful permanent residents give or spend in state or local campaigns. It does not treat a person with unexpired DACA deferred action as a “foreign national.” That means DACA recipients with current status may also give or spend. If DACA has expired, this exclusion does not apply.
