Students cannot be barred from having or using a phone during an emergency or a perceived threat. This does not apply if the school's comprehensive safety plan explicitly covers that situation. A teacher or administrator may allow phone use with reasonable limits. A doctor may require phone access for a student's health or well-being. Phone use required by a student's IEP is allowed.
Schools and their staff cannot monitor, collect, or access a student's online activity under this law. This protects student privacy while at school or under school supervision.
Every school district, county office of education, and charter school must adopt a student smartphone policy by July 1, 2026. The policy limits or bans phone use at school and when students are under school supervision. Schools must involve parents, students, and educators and use evidence-based practices that support learning and well-being. Policies must be updated at least every five years. Schools may include enforcement steps that limit access to phones.
