Rural hazardous materials program fees set by workload

County hazardous materials programs that operate under the cited law must use one fee system that meets Section 25404.5. They must base fee levels on a workload analysis of direct and indirect costs. Fees must be set so fee money plus any state allocation covers all necessary program costs. This ties local fees to the actual work and may change what businesses pay.

Funding for rural hazardous materials programs

The law creates the Rural CUPA Reimbursement Account in the state General Fund. The California Secretary for Environmental Protection allocates money from it to eligible counties. A county qualifies if it had no certified CUPA on or before January 1, 2000 and runs the program under the cited law; and, if the Legislature provides funds, every county under 150,000 people is eligible. Funding is capped by population: under 70,000 people, up to 75% of approved costs; over 70,000 and under 100,000, up to 50%; over 100,000 and under 150,000, up to 35%. No county can receive more than $60,000 total. Funds must be used to run the unified hazardous materials program as agreed with the Secretary.
