Coastal local governments must plan for sea rise

The law requires each local government in the coastal zone or the San Francisco Bay area to have a sea level rise plan. The plan is part of a local coastal program approved by the California Coastal Commission or a Bay shoreline resiliency plan approved by the San Francisco Bay Conservation and Development Commission. Plans must use the best available science and include a vulnerability check that addresses equity for at‑risk communities. Plans must list adaptation strategies, recommended projects, and the lead planning and implementation agencies. The update timeline is set by the local government with the applicable commission and must include an economic impact analysis of costs to critical public infrastructure and ways to carry out the projects. Critical public infrastructure includes transit, roads, airports, ports, water systems, wastewater plants, landfills, powerplants, and railroads. The Coastal Commission or the Bay Commission may accept existing local plans or data to meet some or all requirements. All affected local governments must comply by January 1, 2034.

Optional early help from Coastal Commission

The law encourages local governments to consult early with California Coastal Commission staff by January 1, 2029 when preparing a local coastal program or amendment. Early consultation is voluntary and does not block later plan submission. To start, the local government must write to staff and send a summary of its sea level rise plan work. It may also send a draft local coastal program or amendment. Meetings can be one time or regular, with a schedule both sides agree to. Commission staff must give written recommendations on what could prevent certification and what meets the plan rules. Staff must provide this guidance within a reasonable time the parties agree on.
