Agencies must pay some attorney fees

When a court awards attorney’s fees under CCP 1021.5 or a WIC 10962 writ case against the state, the affected agency pays from its operations budget. The State Controller issues the payment with approval from the Director of Finance, and it is charged to the year paid. Each payment must fully and finally settle the fee claim for a single action. No partial or installment payments. If the agency lacks enough funds to pay in full, the Director of Finance must notify the chairs of the Joint Legislative Budget Committee and the Senate and Assembly Budget Committees, under Items 9840-001-0001, 9840-001-0494, and 9840-001-0988.

Funds and public tracking for federal lawsuits

The Department of Finance can add up to $25 million to budget items to defend or challenge federal actions. It must give at least 10 days’ notice to the Joint Legislative Budget Committee before any increase. Money can be encumbered through June 30, 2026, and spent through June 30, 2028. Finance may create a new item number if needed to make an allocation. The Department of Justice must report each year by August 1 through 2028 on how the money is used, including outside counsel costs and any administrative actions. DOJ must run a public website with case details, updated after each filing and at least monthly; this ends January 20, 2029.
