When a platform knows a user is under 18, it must say the chatbot is AI and not human. By default, it must remind the minor at least every three hours during long chats to take a break and that it is not human. It must block sexual pictures and must not tell minors to do sexual acts. Apps, browsers, and other access points must also warn that chatbots may not be right for some minors.
If a company breaks these chatbot rules and you are harmed, you can sue. You can ask a court to stop the harm. You can get money: the greater of your actual loss or $1,000 for each violation. You can also recover reasonable attorney’s fees and costs. You must show an injury in fact.
Operators must clearly say when a chatbot could be mistaken for a human, and state it is not human. They must keep suicide-prevention rules that stop suicidal or self-harm content. If a user expresses suicidal thoughts, the system must send a notification that points to crisis hotlines or text lines. Companies must post these rules on their websites. A chatbot cannot interact with users unless these rules are in place.
