Cities and counties with a compliant housing element and a "prohousing" designation get extra points on state grants. The preference applies to award cycles after July 1, 2021. It covers programs like Affordable Housing and Sustainable Communities, Transformative Climate Communities, and Infill Infrastructure Grants. The Housing Department adopts emergency rules by July 1, 2021 and keeps them until permanent rules start. By January 1, 2021 and each year after, the Department posts the eligible program list. It also shares prohousing designations with other agencies so they apply the preference.
The law limits extra points for safe parking and safe camping programs. It also limits points for faster approvals of shelters and navigation centers. These points cannot be worth more than the minimum points for policies that plan, approve, or build housing. This shifts more scoring weight to housing planning and construction actions.
A small rural jurisdiction means a city under 25,000 people or a county under 200,000. Starting with the seventh housing element cycle, the Housing Department can review a small rural area's housing element materials on request. This can reduce extra paperwork if the housing element is in compliance. The Department cannot require renewal of a prohousing designation for at least four years, but it can revoke one. These rules apply only if both this law and AB 36 are effective by January 1, 2026. Both must amend the same code section, and this law must be enacted after AB 36.
