The law excludes certain solid-waste rules for small composting sites. It applies to green, agricultural, food, and vegetative food materials. Private sites qualify when total feedstock plus compost on site is 200 cubic yards or less. Public agency sites qualify up to 500 cubic yards. The department may raise these limits by regulation. A composter may give away or sell up to 5,000 cubic yards of compost each year. The department may raise that annual amount for compost made from large-scale biomass events.
Farms can compost plant material from a large-scale biomass event, like removing an orchard, without some state solid-waste rules. The farm cannot be a solid-waste facility. You may not compost whole or partial animal carcasses or animal byproducts other than manure. You may blend in offsite agricultural materials, byproducts, or manure, but you must keep origin records for at least five years and show them on request. You may use this exclusion no more than once every 10 years, and the composting cannot last more than 24 months. Anyone using these exclusions must still get all required local health and land-use permits and other approvals.
