Limits on diesel rail resales by agencies

The law restricts public agencies from selling, donating, or transferring decommissioned diesel on-track equipment for continued use. "Continued use" means running the diesel engine to power the equipment or for any other purpose. A transfer is allowed only if both are true: the equipment is EPA Tier 2, Tier 3, or Tier 4 (or has the same emissions) or the diesel engine is removed; and the agency approves the deal at a public hearing. This limits resale that would keep old diesel engines running, while allowing limited, cleaner or engine-free transfers with public approval.
