Privately funded tenant improvements on these leased parcels must pay California prevailing wages when costs are above set amounts. The threshold is more than $50,000 for construction, and more than $30,000 for alteration, demolition, repair, or maintenance. Starting January 1, 2027, these dollar limits adjust each year with the CPI‑U. The Port must give written notice of these wage rules to tenants, subtenants, and prospective tenants.
The law lets the Port of Oakland lease certain after‑acquired parcels in Jack London Square for non‑trust uses until February 1, 2066. It covers sites including 100 & 101 Washington St., 98 Broadway, 255 2nd St., 66 Franklin St., 70 Washington St., and 55 Harrison St. Leases must get fair market rent, keep public access, aim to draw statewide visitors, and end by February 1, 2066. All income from these non‑trust leases must fund public‑serving waterfront work like seating, plazas, wayfinding, equitable access, and visitor programs. Leases must promote a balanced, public‑serving tenant mix and otherwise follow the Port’s granting statutes and public trust rules. The Port must make required findings at a public meeting; any lease without those findings is void. The Port must send an annual report to the State Lands Commission by January 15, 2027, and every year until 2066. The related Stipulated Judgment is paused for these parcels until February 1, 2066, and normal trust limits return on February 2, 2066.
