Bus operators: fuel tax break, 1-cent fee

Beginning the first day of the first calendar quarter that starts more than 90 days after this law takes effect, many bus operations are exempt from state diesel and use fuel taxes. Local transit run by a transit district, transit authority, city, or county qualifies, including service through a wholly owned nonprofit. Passenger stage corporations qualify only on urban or suburban routes or between nearby cities, and only on lines up to 50 miles one way. Single-city common carriers qualify if at least 98% of their route miles are within that city and they are not under passenger stage rules, and school districts, community colleges, and county superintendents qualify when they run school buses. When these exempt buses use state highways or freeways, they pay 1 cent per gallon of exempt fuel; that payment is treated as a tax.

Charter bus operators excluded from break

Charter-party passenger carriers do not qualify for the bus fuel tax exemption. They must keep paying any fuel taxes or other required payments under state law.

Private bus contractors need newer contracts

Private companies can get the bus fuel tax exemption only when using fuel to provide services under contracts with public agencies. For general public transit contracts, the contract must be signed after January 1, 1979. For pupil transportation contracts with a school or community college district or a county superintendent, the contract must be signed after September 30, 1984. The exemption applies only to fuel used while doing the work under those contracts.
