Stronger ride-share protection during trips

From when a driver accepts a ride until it ends, the company must carry $1,000,000 in primary liability coverage. While you are in the car, the company also provides uninsured and underinsured motorist coverage of $60,000 per person and $300,000 per crash. The insurer for this on-trip time must defend and pay covered claims. Required insurance amounts do not cap what a person can seek in court; people can still claim damages above policy limits.

Faster access to ride-share coverage

Ride-share coverage does not wait for a personal auto insurer to deny a claim. If a driver’s required coverage has lapsed, the company must pay from the first dollar of the claim. This reduces delays and coverage gaps for drivers, passengers, and other people in a crash.

Logged-on coverage before and after rides

When a driver is logged on but not on a trip, the company’s insurance is primary. It must cover at least $50,000 per person and $100,000 per crash for injury, and $30,000 for property damage. The company must also keep at least $200,000 extra liability coverage for each incident in these times. The insurer for these periods has the only duty to defend claims from accidents that happen then.

Ride-share insurance rules tied to AB 1340

This law becomes operative only if AB 1340 is enacted and effective by January 1, 2026. If AB 1340 is not in effect by that date, these insurance rules do not take effect.

Driver insurance must cover app use

A company can count a driver’s own policy only after it verifies the policy is written to cover work on the app. This applies to the $1,000,000 on-trip coverage and to logged-on coverage. Drivers may need endorsements or a different policy, which can add cost. The aim is to make sure the right coverage is in place when you drive for the app.
