New limits on special faculty permit holders

If you hold a special faculty permit, you may only practice at the medical school or its affiliates. You may also practice at an academic medical center and its affiliates where you teach and the school or center has direct responsibility. Time in this permit role does not count toward California postgraduate training or any exam waiver. You cannot be made a division chief or department head unless the Medical Board gives written approval first.

Who can get a special faculty permit

You can apply if you are academically eminent and have a current medical license from another state or country. You are academically eminent if you hold or were offered a full-time, tenure-track full professor role at a California medical school or academic medical center. Or you are clearly outstanding, offered a full-time professor or associate professor role, and there is a great need for you. You must not be disqualified under Section 480 and must pay the application and initial licensure fee. If you held a Section 2113 position for two or more years, the Medical Board can waive that rule.

New path for NCI cancer centers

The law updates who counts as an academic medical center. A center must be licensed in California, do ongoing peer review, and conduct clinical and basic research. It must train 250 residents each year, or, if it is an NCI comprehensive cancer center, at least 25 residents or fellows each year. The counts are measured each year beginning January 1. It must also have over 100 research students or postdocs, include foreign medical graduates in research, and offer clinical observer experiences. Centers need WASC and ACGME accreditation, but NCI comprehensive cancer centers need only ACGME.

How permit applications are reviewed and capped

The Medical Board uses a review committee with two division members, one representative from each medical school, and one person chosen by academic medical centers. The school or center sponsoring an applicant cannot vote on that applicant. The academic centers’ representative must come from a center that trains at least 250 residents a year. The Board may approve at most five permits from any one academic medical center in a calendar year.
