The law requires the employer to keep the same health plan for a fallen worker’s spouse. It covers local firefighters, specified peace officers, and Orange County Sheriff's Special Officers. It applies when the worker is killed on duty or dies from an on-duty injury caused by external violence or physical force. Minor children stay covered under the spouse’s plan; if there is no spouse, coverage lasts until age 26. Survivors of deaths before September 30, 1996, are also covered. The spouse can choose a one‑time lump‑sum survivors benefit instead of monthly survivor benefits and continued coverage.
If you are a surviving spouse on continued coverage, you cannot add a new spouse or stepchildren to that plan. This follows state law. New family members need other health insurance.
