Advisory boards teleconference access rules

Advisory bodies may meet by teleconference but must name a primary physical location where the public can attend and take part, with staff present and the agenda posted. At least 24 hours before the meeting, they must post and email a notice naming any remote members and include the phone or web access info; remote members’ locations stay private. The public must be able to listen or watch remotely with access equal to members’ remote access. Members must appear on camera during the open online portion when feasible, and minutes must list any members who joined remotely. If required remote access fails and cannot be fixed, the meeting must end or adjourn with prompt notice.

New rules for state teleconference meetings

The law lets state boards hold meetings by phone or online. Agendas and notices must list how to join by phone or web and each site’s address, and the public must get access equal to remote members. The open part must be visible and audible at every site, and agendas must be posted online and at each site on meeting day. You can speak live without sending comments ahead of time, and ADA accommodations must be received and handled quickly. At least one member must be at each site, and a majority must be together at one site, unless a short, approved disability exception applies. Remote members must appear on camera during the open online portion when feasible and must say if other adults are in the room. All votes are by rollcall, actions and each vote are reported, emergency items cannot be in closed session, and meetings end or adjourn if required remote access fails.

Teleconference rules change in 2030

On January 1, 2030, new advisory teleconference rules take effect. A quorum must be physically present at the named primary location, remote members do not count toward quorum, and all decisions must be by rollcall. The current teleconference sections (11123.2 and this version of 11123.5) are repealed that day.
