Coastal permit waiver for 100% affordable homes

The law waives the coastal development permit for certain 100% affordable housing in selected coastal infill areas. Projects must be made up entirely of deed‑restricted units for very low‑, low‑, or moderate‑income households, excluding managers’ units. By July 1, 2027, the Coastal Commission identifies infill areas in at least three jurisdictions that did not have a certified local coastal program at that time. The waiver in an area takes effect only after a two‑thirds vote by the Commission to certify the exclusion. The exclusion lasts until June 30, 2037, and ends earlier in a jurisdiction once its local coastal program is certified on or before that date.

How coastal exclusion areas are chosen

The Coastal Commission, with the housing department, picks areas from different coastal regions and population sizes. It chooses the largest feasible areas, furthers fair housing, considers each community’s housing element sites, and avoids places at risk from sea level rise. Starting August 1, 2027, the Commission posts clear maps of the exclusion areas online. By January 1, 2035, it reports how many excluded projects are built or under construction. This reporting ends on January 1, 2039.

Local approvals and exclusion notice required

Even if your residential project is in a categorically excluded area, you must still get all city or county land use entitlements. Before you start construction, you must ask the Coastal Commission for a notice of exclusion. The Commission issues a notice that confirms your project is excluded from the coastal development permit.
