The law covers peace officers (Penal Code §830+) and firefighters employed by a city, county, city and county, or fire protection district. When the worker proves total damages are more than the net civil recovery after paying the employer’s claim, and the third party’s insurance limits cannot fully pay those damages, the employer’s recovery is capped at one-third of the applicable liability insurance limits. That one-third cap comes first and controls all settlements and judgments before any lien or subrogation rules. The worker can settle with the third party without the employer’s consent. Any settlement must say the employer gets no more than one-third of the third-party insurance limits, and the employer’s reimbursement is limited to that allocated share.
For those covered peace officers and firefighters, the employer cannot take any credit or offset against future workers’ compensation benefits because of a third-party recovery. This ban covers temporary disability, permanent disability, medical treatment, and vocational rehabilitation. The Workers’ Compensation Appeals Board cannot allow any such credit or offset. The employer still must provide all workers’ compensation benefits required by law.
