Beginning July 1, 2026, if your home is a total loss, you can rebuild or buy elsewhere and still get building‑code and replacement‑cost benefits. The payout cannot exceed what it would cost to rebuild at the original site, and the insurer cannot deduct the value of new land. After a declared state of emergency, you can combine limits from your dwelling, other structures, and needed rebuild expenses to finish the main home. Other structures are valued at full replacement cost even if you do not rebuild them. For a furnished primary home that is a total loss in a declared emergency, your insurer must offer at least 60% of your contents limit upfront, capped at $350,000, without an itemized list; you can itemize later for more up to your limit. You get at least 36 months after a declared emergency loss (12 months otherwise) to collect full replacement cost, with required six‑month extensions for good cause. In declared emergencies, insurers cannot require proof of loss before 100 days and must give extra three‑month extensions for good cause.
By March 1, 2026 and each year after, admitted insurers with $50 million or more in prior‑year premiums for certain property lines must report reinsurance placement and catastrophe‑model use. Holding company systems may file one consolidated report, and insurers must answer the commissioner’s follow‑up questions promptly. The department keeps company‑level data confidential and not subject to the Public Records Act or subpoenas, and staff cannot testify about report contents. The Insurance Commissioner posts an aggregated public report each year that hides company identities. Missing reports can trigger fines up to $5,000 per 30 days (up to $10,000 if willful), capped at $100,000, with a possible 30‑day extension and appeal rights. The commissioner can set report formats and adopt rules to run the program.
