HIV care records shared to keep coverage

The state and qualified partners may share HIV diagnosis and treatment records only to enroll you in Medi‑Cal, bridge programs, Medicaid expansion, or Covered California plans and to prevent gaps in care. Only the minimum needed facts can be shared, and surveillance data are excluded. Records must follow HIPAA and state privacy laws, and they cannot be used in court.

ADAP income checks using tax records

The health department now checks ADAP applicants’ income with the Franchise Tax Board. The department shares your name and SSN or ITIN, and FTB sends your federal and California AGI, tax‑exempt interest, tax‑exempt Social Security, foreign earned income (including the housing amount), and family size. Your household counts you, your spouse or registered domestic partner, and your tax dependents. Shared records are confidential, access is minimized, and staff sign yearly confidentiality agreements. After the check, FTB must return or destroy the data.

Name-based HIV reporting and privacy safeguards

Providers and labs must report HIV cases by name to local health officers using secure, traceable methods or a secure electronic system. Providers may share identifying details with public health only when needed to complete a report, investigate and control disease, or link someone to care. The law keeps anonymous HIV testing available at alternative sites. Reported HIV data are tightly protected: not allowed in court, not shared with the federal government, and staff must sign annual confidentiality agreements. Officials must investigate and report any breaches, and wrongful disclosures face penalties.
