The law lets a city or county in the same county as a federally recognized tribe make a voluntary agreement with that tribe. New tribal housing in the agreement can count toward the local housing need goals. The homes must be within or next to the city or county, and must meet the U.S. Census definition of a housing unit. The city or county must have permitting power, or the agreement must show the homes will be built with permits or approvals, proof of approval in the current planning cycle, or data on timing and income levels. A city or county cannot require a tribe to give up sovereign immunity to sign the agreement. Tribal housing already counted toward local goals stays counted.
