The law bars covered public employees convicted of certain felonies tied to their official duties from any public job for five years. Crimes include bribery, conflicts of interest, embezzlement, extortion or theft of public money, perjury, and conspiracy. The five years starts on the later of the final conviction date or the date of release from incarceration. The ban covers jobs with any city, county, district, or other state public agency, including people working for a city under contract, and it applies to all cities, including charter cities. For this rule, a “public employee” is someone employed at will to serve an elected officer who took office or was reelected on or after January 1, 2013.
The law permanently disqualifies a city manager or city attorney convicted of any listed felony from serving again in an equivalent public role. This applies whether the person held the role as an employee or provided those services under contract. For this rule, “city attorney” means someone employed under Section 41801 on or after January 1, 2026. “City manager” means someone employed under Section 34851 on or after January 1, 2026.
