No-subscription, easier payments at chargers

The law bans forcing drivers to buy a subscription to use a paid charger. Operators must show the full price at the point of sale, including any roaming fees for nonmembers. For stations first installed or first open to the public on or after July 10, 2023, paid chargers must take contactless tap-to-pay credit and debit cards and also offer either a toll-free phone line or an SMS option to start and pay. DC fast chargers that are new on or after July 10, 2023 must support Plug and Charge (ISO 15118) by July 10, 2024. Stations can sell memberships, but they must still let nonmembers pay per use through these options.

Roaming rules for big charging networks

If no national billing standard existed by January 1, 2015, the Energy Commission may adopt billing rules for roaming payments. If it does, paid stations must meet them within one year. Roaming standards require large network providers to accept payments from users of other large networks and from automakers, making cross‑network charging easier. The rules preserve providers’ choice to use bilateral or hub roaming agreements. The standards apply to providers that manage at least 100 public chargers in the state, and the commission can raise that threshold.

Clear charger info and better signs

Charging providers must give the National Renewable Energy Laboratory the station location, fee schedule, accepted payment methods, and any roaming charges for nonmembers. Stations must follow federal labeling rules in 16 C.F.R. Part 309. When it is commercially reasonable and feasible, sites add clear directional signs in the parking area to help drivers find chargers.

App-only payments allowed at big arenas

A charger at an arena with 15,000 or more seats can require in‑app payment if access to the station is only through that app. This is a narrow exception to the general ban on app‑only payment.

Future updates to charger payment rules

The Energy Commission can change which payment methods stations must offer as technology or costs change. Under one section, any such regulation cannot take effect before January 1, 2028. Which section applies depends on whether both this bill and Assembly Bill 1423 are enacted by January 1, 2026 and on the order they pass. If Section 1.5 becomes operative under those conditions, it governs and Section 1 does not.
