A qualified health supervisor must get a doctor’s prescription for each school with the right doses for student ages and weights, and must stock and restock devices. If there is no health supervisor, an administrator does this. Pharmacies or manufacturers may supply devices for exclusive LEA use with a doctor’s written order. Districts must keep buy and use records for three years and destroy expired devices. Doctors who sign these orders are shielded from lawsuits unless they act with gross negligence or willful misconduct. The state and districts may accept donations, grants, or devices from manufacturers to support the program.
Public schools must keep emergency epinephrine at every school and LEA-run childcare site in an easy-to-reach spot. A school nurse, or a trained volunteer if no nurse is there, may give it for signs of anaphylaxis. Used devices must be replaced as soon as possible and no later than two weeks, and before they expire. Schools must ask for volunteers each year and give yearly training under state standards reviewed at least every five years. Volunteers must follow the emergency steps, like calling 911, and the district must defend and indemnify them in writing.
Private schools may choose whether to keep stock epinephrine and trained staff after checking local 911 response times. If a private school does not participate, it does not receive state funds tied to this provision. Public school duties remain in place.
Students who need medicine during the school day can get help from a nurse or trained staff. A student may carry and use their own prescribed epinephrine if the school has a doctor’s statement that the student can self-administer and a parent’s written consent and liability release. These forms must be renewed at least yearly and whenever the prescription changes. A student who uses epinephrine other than as prescribed may face school discipline.
